Privacy Policy

Effective Date: 25 March 2026 · Last updated: 27 August 2026

This Privacy Policy explains how PVTL Digital Ltd, trading as Pivotal ("we", "us", or "Pivotal") collects, uses, shares, and protects your personal data when you use the Landing Platform service ("Service"). We are committed to protecting your privacy in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

1. Data Controller

PVTL Digital Ltd, trading as Pivotal (company no. 12857920), is the data controller for the personal data we collect about you as a user of the Service. For personal data that you upload to the Service about your own customers or contacts, you are the data controller and we act as your data processor.

The Service also includes a media contacts directory — a curated database of journalists and media professionals compiled by us. For that directory, PVTL Digital Ltd is an independent data controller, and customers who use it act as independent controllers of their own outreach. How we handle media professionals' data — including sources, retention, and how to be corrected or removed — is set out in our Media Contacts Privacy Notice.

2. Information We Collect

Information you provide:

• Account information: Name, email address, company name, phone number, and billing details when you create an account
• Profile information: Avatar, job title, industry, team size, and preferences you set within the Service
• Content: Landing pages, images, documents, branding assets, and other content you create or upload
• Communications: Messages you send to us via support, feedback, or other channels

Information collected automatically:

• Usage data: Pages visited, features used, actions taken, and timestamps
• Device information: Browser type, operating system, screen resolution, and device identifiers
• Network information: IP address, approximate location (country/region), and referring URL
• Cookies and similar technologies: See Section 9 below

Information from third parties:

• OAuth providers: When you connect social media or other accounts, we receive basic profile information as authorised by you
• Payment processors: Transaction confirmations and billing status from Stripe or PayPal
• Media contacts directory: Professional details of journalists and media professionals, compiled from publicly available sources and licensed datasets and maintained by our team — see the Media Contacts Privacy Notice
• Contact enrichment providers: Where you use enrichment features, we obtain professional details about your business contacts (such as job title, employer, work email and phone number) from third-party business databases, acting on your instruction

3. How We Use Your Information

We use your personal data for the following purposes:

• Service provision: To operate, maintain, and improve the Service, including AI-powered features such as landing page generation and brand analysis
• Account management: To create and manage your account, process payments, and communicate about your subscription
• Customer support: To respond to your enquiries and provide technical assistance
• Security: To detect, prevent, and investigate security incidents, fraud, and abuse
• Product improvement: To analyse usage patterns and improve the Service's features and performance
• Communications: To send you service updates, security alerts, and (with your consent) marketing communications
• Legal compliance: To comply with applicable laws, regulations, and legal processes

4. Legal Basis for Processing

Under the UK GDPR, we process your personal data on the following legal bases:

• Performance of contract: Processing necessary to provide the Service you have subscribed to
• Legitimate interests: Processing for our legitimate business interests (such as security, fraud prevention, and product improvement), where these are not overridden by your rights
• Consent: Where you have given explicit consent (such as for marketing communications). You may withdraw consent at any time
• Legal obligation: Processing necessary to comply with our legal obligations

5. Data Sharing

We do not sell your personal data. We may share your data with:

• Service providers: Trusted third parties who assist us in operating the Service, including cloud hosting, payment processing (Stripe, PayPal), email delivery, and AI services (Anthropic). These providers are contractually bound to protect your data
• Within your organisation: Other members of your team or organisation as determined by your account settings
• Legal requirements: When required by law, court order, or governmental authority, or to protect our rights, safety, or property
• Business transfers: In connection with a merger, acquisition, or sale of assets, your data may be transferred to the successor entity

6. AI Processing

The Service uses AI models (including Claude by Anthropic) to power features such as landing page generation, content analysis, and brand extraction. When using these features:

• Only the data necessary for the specific task is sent to the AI provider
• AI providers process data according to their own privacy policies and our data processing agreements
• Your data is not used to train AI models
• You can choose not to use AI-powered features

7. International Data Transfers

Your data may be transferred to and processed in countries outside the United Kingdom. Where such transfers occur, we ensure appropriate safeguards are in place, including:

• UK adequacy regulations for countries deemed to provide adequate data protection
• International Data Transfer Agreements (IDTAs) or Standard Contractual Clauses (SCCs) approved by the Information Commissioner's Office

8. Data Retention

We retain your personal data for as long as your account is active or as needed to provide the Service. Upon account termination:

• Your data is available for export for 30 days
• After 30 days, your data is permanently deleted from our active systems
• Backup copies may persist for up to 90 days before being overwritten

We may retain certain data for longer periods where required by law (such as financial records for tax purposes) or to resolve disputes.

9. Cookies and Tracking

We use cookies and similar technologies for:

• Essential cookies: Required for the Service to function (authentication, security, session management)
• Analytics cookies: To understand how the Service is used and to improve it
• Preference cookies: To remember your settings and choices

You can manage cookie preferences through your browser settings. Disabling essential cookies may affect the functionality of the Service.

10. Your Rights

Under the UK GDPR, you have the following rights:

• Access: Request a copy of the personal data we hold about you
• Rectification: Request correction of inaccurate or incomplete data
• Erasure: Request deletion of your personal data ("right to be forgotten")
• Restriction: Request that we restrict the processing of your data
• Portability: Receive your data in a structured, machine-readable format
• Object: Object to processing based on legitimate interests or for direct marketing
• Withdraw consent: Where processing is based on consent, withdraw it at any time

To exercise any of these rights, please contact us at privacy@pivotal.digital. We will respond within 30 days.

You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

11. Children's Privacy

The Service is not intended for individuals under 16 years of age. We do not knowingly collect personal data from children. If we become aware that we have collected data from a child, we will take steps to delete it promptly.

12. Security

We implement appropriate technical and organisational measures to protect your personal data, including encryption in transit and at rest, access controls, regular security assessments, and incident response procedures. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Google User Data & API Services

When you connect a Google service (such as Google Ads or Google Search Console), Landing Platform accesses your Google advertising and search-performance data solely to display reporting and analytics within your own account. We do not sell, rent, transfer, or disclose your Google user data to any third party, and we do not use it for advertising or to train generalised artificial-intelligence or machine-learning models. Google user data is shared only with the infrastructure sub-processors strictly necessary to operate the service (for example, our cloud hosting provider), and never for any other purpose. You can revoke Landing Platform's access to your Google data at any time from your Google Account permissions page, or by disconnecting the integration in your settings.

Landing Platform's use and transfer of information received from Google APIs to any other application will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website and, where appropriate, by email. The "Effective Date" at the top of this policy indicates when it was last revised.

1. Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service during your subscription term solely for your internal business purposes. This right is personal to you and may not be sublicensed, assigned, or transferred.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Maintain unique login credentials for each authorised user
• Promptly notify us of any unauthorised access to your account
• Comply with all applicable laws and regulations in your use of the Service

You agree not to:

• Access, monitor, copy, scrape, screenshot or interact with the Service by automated means — including bots, scripts, headless browsers, AI agents and agentic browsers — without our prior written permission. The Landing API and MCP connector, used under their own terms, are the only permitted forms of programmatic access
• Use the Service, or any output, screenshot or extract of it, to build, train or improve a product that competes with the Service, or to reproduce its features, interface or workflows
• Circumvent, disable or probe any measure we use to detect or prevent automated access. We record such attempts and may suspend the account

3. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance during off-peak hours and will provide reasonable advance notice of planned downtime where practicable.

We shall not be liable for unavailability caused by circumstances beyond our reasonable control, including but not limited to acts of God, internet service disruptions, distributed denial-of-service attacks, or government action.

4. Changes to the Service

We continuously improve the Service and may update, modify, or discontinue features with reasonable notice. We will notify you of material changes that adversely affect your use of the Service. Content on our website may be updated without notice.

5. Intellectual Property

All intellectual property rights in the Service, including software, design, documentation, and trademarks, belong to PVTL Digital Ltd or our licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

The design, layout, workflows, wording and arrangement of the Service's interface are protected by copyright and database right, and are reserved from text-and-data mining (TDM-Reservation).

We claim no intellectual property rights over the content you upload to or create using the Service. Your data remains yours.

If you provide feedback or suggestions about the Service, you grant us a royalty-free, worldwide, perpetual licence to use and incorporate that feedback into our products and services.

6. Third-Party Services

The Service may integrate with or link to third-party services (such as payment processors, social media platforms, or AI providers). Your use of such services is governed by their respective terms. We are not responsible for the availability, accuracy, or practices of any third-party service.

7. Billing and Payments

7.1 All charges are due in full and payable in advance for each subscription period, unless otherwise agreed in writing.

7.2 We accept payment by credit or debit card (processed immediately) or by invoice (payable within 30 days).

7.3 Subscriptions automatically renew for equivalent periods at the then-current standard rates, unless you cancel before the renewal date.

7.4 All charges are non-refundable except where expressly stated or required by law. No refunds or credits will be issued for partial subscription periods.

7.5 If payment is not received within the applicable grace period, we reserve the right to charge interest at 2% per month on overdue amounts and to suspend your access to the Service.

7.6 You are responsible for all applicable taxes. Where we are legally required to collect taxes, these will be added to your invoice.

8. Suspension and Termination

8.1 We may suspend your access to the Service if you breach these Terms, subject to providing you with written notice and a reasonable opportunity to cure (not less than 15 days), except in cases of material security violations where immediate suspension may be necessary.

8.2 You may terminate your subscription at any time through your account settings or by contacting us at support@landing.pivotal.digital.

8.3 Upon termination, we will retain your data for 30 days to allow you to export it. After this period, your data will be permanently deleted in accordance with our Privacy Policy.

8.4 Any remaining subscription charges at the time of termination remain due and payable, unless we have materially breached these Terms.

9. Data Privacy and Security

We process your personal data in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We implement appropriate technical and organisational measures to protect your data. You agree to keep your authentication credentials confidential and to comply with any security guidelines we publish.

10. Confidentiality

Each party agrees to treat the other party's confidential information with no less than reasonable care and to use it only as necessary to perform obligations or exercise rights under these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.
• Our aggregate liability for all claims arising under or in connection with these Terms shall not exceed the total charges paid by you in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

13. Indemnification

13.1 We will indemnify you against any third-party claim that your permitted use of the Service infringes that party's intellectual property rights, provided you promptly notify us, give us sole control of the defence, and cooperate with our reasonable requests.

13.2 You will indemnify us against any third-party claim arising from your breach of these Terms, your content, or your use of the Service in violation of applicable law.

14. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and any applicable order form, constitute the entire agreement between you and PVTL Digital Ltd.

Amendments: We may update these Terms from time to time. We will provide at least 30 days' notice of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Severability: If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
